本《“开喝品鉴家”会员服务协议》（以下简称“本协议”）由您与北京市柒感商贸有限公司（注册地址：北京市顺义区高丽营镇金马园二街1122号，以下简称“开喝”或“我们”）就您购买、使用“开喝”App（以下简称“本App”）提供的会员服务所订立。本协议是《“开喝”用户服务协议》《“开喝”隐私政策》的补充协议，与上述协议共同构成完整协议并具有同等法律效力；本协议未约定事项，以前述协议为准。
2.1 开通会员服务后，您可在会员有效期内享有以下权益（具体以本App购买页面及实际提供为准）：
2.2 会员权益的具体内容、数量及形式可能因产品迭代而调整，我们会在调整前通过本App公告、推送等合理方式予以提示。该等调整不会实质性减损您在已购买的当期会员有效期内的核心权益。
2.3 会员权益仅限您本人通过会员账号在本App内使用，不得赠与、出租、出借、转让、售卖或以任何形式许可他人使用，亦不得用于商业转售或其他非法获利。
3.1 会员服务为付费虚拟商品。我们提供包括但不限于以下套餐（最终价格、套餐种类与时长以本App购买页面实际展示的标价为准）：
3.2 您通过苹果 App Store 的应用内购买（In-App Purchase）方式购买会员服务，支付由 Apple 提供并处理，您应遵守 Apple 的相关条款与规则。购买成功后，相应费用将通过您的 Apple ID 账户结算。
3.3 设备与账号绑定：苹果 App Store 允许您在未登录账号的情况下购买会员，此时会员权益将与您的购买设备/Apple ID 绑定。为便于您在多设备使用及找回权益，建议您登录并绑定本App账号后再行购买。
3.4 价格说明：基于市场与业务发展需要，会员服务的定价可能不时调整，价格调整自公布之日起生效。您在调整生效前已购买的会员权益不受影响；调整生效后再次购买的，以届时实际展示的价格为准。购买页面如展示划线价格，仅为市场参考价或曾经的销售价，不代表实时成交价，实际成交价以您支付时页面展示的价格为准。
3.5 支付成功后会员权益通常即时生效。如因网络、系统或第三方支付渠道原因导致权益未能及时到账，请稍后重试或通过本协议第 12 条的方式联系我们处理。
4.1 本会员服务为“非自动续费”商品。会员到期后不会自动扣费、不会自动续期，需要由您在到期后手动重新购买方可继续享有会员权益。
4.2 由于本服务不涉及自动续费，您无需进行“取消订阅”操作；会员到期后若您未再次购买，会员权益将自动失效，不会产生任何后续费用。
4.3 您可在本App的会员页面查看当前会员状态及到期时间，并自行决定是否在到期前后再次购买。
5.1 会员服务属于一经开通即可使用的虚拟数字商品。除因法定情形、本协议另有约定，或因本App服务存在重大瑕疵导致您无法正常使用所购服务外，您在完成购买并支付后，已支付的会员费用原则上不予退还。请您在购买前确认所选套餐与个人需求。
5.2 会员服务通过苹果 App Store 购买，退款申请由 Apple 受理并依据 Apple 的退款政策进行审核与处理。如您需要申请退款，请通过 Apple 官方渠道（reportaproblem.apple.com）提交申请，是否退款及退款金额以 Apple 的最终审核结果为准。如经 Apple 为您办理退款，我们有权相应收回对应的会员权益。
5.3 存在下列情形之一的，我们有权取消、中止或终止您已开通的会员服务，且已支付的费用不予退还，由此造成的损失由您自行承担：
6.1 您应妥善保管会员账号及密码，并对使用您账号进行的所有活动负责。非因我们的过错导致账号或密码泄露、遗失的，由此产生的损失由您自行承担。
6.2 如您存在违反法律法规、《“开喝”用户服务协议》或本协议的行为，我们有权视情节轻重采取包括但不限于警示、限制或暂停部分功能、中止或终止会员服务、限制或冻结账号、永久封禁账号等措施，且无需退还费用；给我们或第三方造成损失的，您应依法承担赔偿责任。
7.1 因不可抗力、政策调整、第三方服务故障、技术维护等原因，会员服务可能出现临时中断；我们将尽合理努力及时恢复，并在必要时对受影响的会员有效期作出合理顺延等补偿安排。
7.2 如本App因经营策略调整等原因需整体停止提供会员服务，我们将提前通过合理方式予以公告，并依据法律法规及公平原则对您尚未使用的会员权益作出妥善处理。
8.1 您理解并同意，受现有技术与互联网环境限制，我们不保证会员服务能够完全满足您的所有要求或符合您的预期，亦不保证服务不会中断，以及服务的及时性、安全性、准确性不会出现差错。
8.2 因不可抗力、系统故障、网络中断、黑客攻击、电信部门或第三方支付机构原因、您的设备或网络问题、您将账号密码告知他人等非归因于我们的原因，导致您无法正常使用会员服务或造成损失的，我们不承担责任，亦不退还相应费用。
8.3 本App通过 AI 生成的酒单、配方及配图等内容仅供参考，不构成任何医疗、健康或专业建议。请您理性饮酒，未成年人禁止饮酒，由此产生的后果由您自行判断并承担。
9.1 若您为未成年人，请在监护人的指导和陪同下阅读本协议，并在征得监护人明确同意后再行购买会员服务。监护人应履行监护职责，妥善保管支付设备、支付账户及密码，避免未成年人在未取得监护人同意的情况下通过账号完成支付。
9.2 如监护人发现未成年人在未取得其同意的情况下购买了会员服务，可通过本协议第 12 条的联系方式或苹果 App Store 退款渠道与我们或 Apple 联系，我们将依据法律法规及实际情况协助处理。
10.1 本App及会员服务所涉及的全部内容（包括但不限于文字、图标、界面设计、AI 生成的素材与模板、软件及其代码等）的知识产权均归我们或相关权利人所有。未经书面许可，您不得以商业目的使用、复制、修改、传播，亦不得进行反向工程、反编译、反汇编或破解。
10.2 关于 AI 生成内容的使用许可与权利归属，适用《“开喝”用户服务协议》的相关约定。
11.1 我们可能根据法律法规变化及业务运营需要适时修订本协议，协议更新后将通过本App公告、推送或更新协议日期等方式予以提示。
11.2 修订后的协议自公布之日起生效。若您在协议变更后继续购买或使用会员服务，即视为您已接受修订后的协议；若您不同意，应停止购买及使用会员服务。
12.1 本协议的订立、生效、解释、履行及争议解决，均适用中华人民共和国大陆地区法律。
12.2 因本协议产生的或与本协议有关的任何争议，双方应首先友好协商解决；协商不成的，任何一方均可向北京市柒感商贸有限公司注册地有管辖权的人民法院提起诉讼。

This DrinkUp Connoisseur Membership Service Agreement (this "Agreement") is entered into between you and Lensflow LTD; hereinafter "DrinkUp," "we," or "us") in connection with your purchase and use of the membership service provided in the DrinkUp App (the "App"). This Agreement is a supplement to the DrinkUp User Service Agreement and the DrinkUp Privacy Policy; together they constitute the entire agreement and carry equal legal effect. Matters not addressed in this Agreement shall be governed by the aforementioned agreements.
2.1 Upon activating the Membership Service, you may enjoy the following benefits during the Membership Term (subject to what is displayed on the App's purchase page and actually provided):
2.2 The specific content, quantity, and form of membership benefits may be adjusted as the product evolves. We will notify you before any such adjustment through reasonable means such as in-App announcements or push notifications. Such adjustments will not materially diminish the core benefits of the Membership Term you have already purchased.
2.3 Membership benefits are for your personal use within the App via your Membership Account only, and may not be gifted, rented, lent, transferred, sold, or licensed to others in any form, nor used for commercial resale or any other unlawful profit-making purpose.
3.1 The Membership Service is a paid virtual product. We offer plans including but not limited to the following (final prices, plan types, and durations are subject to the pricing actually displayed on the App's purchase page):
3.2 You purchase the Membership Service via In-App Purchase through the Apple App Store. Payment is provided and processed by Apple, and you shall comply with Apple's applicable terms and rules. Upon successful purchase, the corresponding fee will be charged to your Apple ID account.
3.3 Device and account binding: the Apple App Store allows you to purchase a membership without signing in to an App account, in which case the membership benefits will be bound to your purchasing device/Apple ID. To make it easier to use the service across devices and restore your benefits, we recommend signing in to and binding your App account before purchasing.
3.4 Pricing: based on market conditions and business needs, the pricing of the Membership Service may be adjusted from time to time, with adjustments taking effect on the date of publication. Membership benefits you purchased before an adjustment takes effect will not be affected; purchases made after an adjustment takes effect will be at the prices then displayed. Any strikethrough prices shown on the purchase page are for market reference or represent previous selling prices only, and do not indicate the current transaction price; the actual transaction price is the price displayed on the page at the time of your payment.
3.5 Membership benefits usually take effect immediately after successful payment. If benefits are not credited in a timely manner due to network, system, or third-party payment channel issues, please try again later or contact us as described in Article 12 of this Agreement.
4.1 The Membership Service is a non-auto-renewing product. When your membership expires, you will not be automatically charged and the membership will not automatically renew; to continue enjoying membership benefits, you must manually purchase again after expiration.
4.2 Since this service does not involve auto-renewal, no "cancel subscription" action is required. If you do not purchase again after your membership expires, your membership benefits will automatically lapse and no further charges will be incurred.
4.3 You may view your current membership status and expiration date on the App's membership page and decide for yourself whether to purchase again before or after expiration.
5.1 The Membership Service is a virtual digital product that becomes usable immediately upon activation. Except where required by law, otherwise provided in this Agreement, or where a material defect in the App's service prevents you from normally using the purchased service, membership fees paid are, in principle, non-refundable once your purchase and payment are completed. Please confirm that your selected plan meets your personal needs before purchasing.
5.2 The Membership Service is purchased through the Apple App Store, and refund requests are accepted, reviewed, and processed by Apple in accordance with Apple's refund policy. If you wish to request a refund, please submit your request through Apple's official channel (reportaproblem.apple.com); whether a refund is granted and the refund amount are subject to Apple's final determination. If Apple issues you a refund, we are entitled to revoke the corresponding membership benefits accordingly.
5.3 In any of the following circumstances, we are entitled to cancel, suspend, or terminate your activated Membership Service without refunding fees paid, and any resulting losses shall be borne by you:
6.1 You shall safeguard your Membership Account and password and are responsible for all activities conducted under your account. If your account or password is disclosed or lost through no fault of ours, any resulting losses shall be borne by you.
6.2 If you violate laws or regulations, the DrinkUp User Service Agreement, or this Agreement, we are entitled, depending on the severity of the circumstances, to take measures including but not limited to issuing warnings, restricting or suspending certain features, suspending or terminating the Membership Service, restricting or freezing your account, or permanently banning your account, without any obligation to refund fees. If your conduct causes losses to us or any third party, you shall bear liability for compensation in accordance with the law.
7.1 The Membership Service may be temporarily interrupted due to force majeure, policy changes, third-party service failures, technical maintenance, or similar causes. We will use reasonable efforts to restore the service promptly and, where necessary, make reasonable compensatory arrangements such as extending the affected Membership Term.
7.2 If the App needs to discontinue the Membership Service as a whole due to business strategy adjustments or similar reasons, we will announce this in advance through reasonable means and handle your unused membership benefits properly in accordance with applicable laws, regulations, and principles of fairness.
8.1 You understand and agree that, subject to the limitations of current technology and the internet environment, we do not warrant that the Membership Service will fully meet all of your requirements or expectations, that the service will be uninterrupted, or that its timeliness, security, and accuracy will be free from errors.
8.2 We shall not be liable, and shall not refund the corresponding fees, where you are unable to normally use the Membership Service or suffer losses due to causes not attributable to us, including force majeure, system failures, network interruptions, hacker attacks, causes attributable to telecommunications authorities or third-party payment institutions, issues with your device or network, or your disclosure of your account password to others.
8.3 Drink lists, recipes, images, and other content generated by AI in the App are for reference only and do not constitute medical, health, or professional advice of any kind. Please drink responsibly; minors are prohibited from drinking alcohol. You shall exercise your own judgment and bear any consequences arising therefrom.
9.1 If you are a minor, please read this Agreement under the guidance and in the company of your guardian, and purchase the Membership Service only after obtaining your guardian's explicit consent. Guardians shall fulfill their guardianship duties by properly safeguarding payment devices, payment accounts, and passwords, so as to prevent minors from completing payments through the account without the guardian's consent.
9.2 If a guardian discovers that a minor has purchased the Membership Service without the guardian's consent, the guardian may contact us or Apple through the contact methods in Article 12 of this Agreement or the Apple App Store refund channel, and we will assist in handling the matter in accordance with applicable laws, regulations, and the actual circumstances.
10.1 The intellectual property rights in all content involved in the App and the Membership Service (including but not limited to text, icons, interface designs, AI-generated materials and templates, and the software and its code) belong to us or the relevant rights holders. Without written permission, you may not use, copy, modify, or distribute such content for commercial purposes, nor engage in reverse engineering, decompilation, disassembly, or cracking.
10.2 The license to use, and the ownership of rights in, AI-generated content are governed by the relevant provisions of the DrinkUp User Service Agreement.
11.1 We may revise this Agreement from time to time in response to changes in laws and regulations and business operational needs. After the Agreement is updated, we will notify you through in-App announcements, push notifications, updates to the Agreement date, or other means.
11.2 The revised Agreement takes effect on the date of publication. If you continue to purchase or use the Membership Service after the Agreement is amended, you are deemed to have accepted the revised Agreement; if you do not agree, you should stop purchasing and using the Membership Service.
12.1 The formation, effectiveness, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of mainland China (the People's Republic of China).
12.2 Any dispute arising from or in connection with this Agreement shall first be resolved through friendly negotiation between the parties. If negotiation fails, either party may bring a lawsuit before the people's court with jurisdiction over the place where Lensflow LTD is registered.
